Individuals can receive a forensic exam regardless of reporting to law enforcement. These forensic exams can be held up to 5 years for those not ready to make a report. If under the age of 18, the forensic exam will be held up to 5 years after their 18th birthday.

How Long do You Have to file a Civil Lawsuit?

NJ previously had a two-year window, but this has now been expanded.

Survivors sexually assaulted when under the age of 18: have until the age of 55 or seven years from time that they became aware that their trauma is linked to their assault.

Survivors sexually assaulted when over the age of 18: now have seven years from the date of harm or seven years from the discovery; whichever is later.

Two Year Lookback (December 1, 2019 – November 30, 2021): Allows all survivors to file during this time regardless of when the assault occurred.

Sexual Assault Survivor Protection Act- An order to protect survivors that are not covered under the Prevention of Domestic Violence Act and/or do not wish to file at the police station.

Filed at the county superior courthouse Monday – Friday during business hours.

Nicole’s Law– An order from the court to protect victims from defendants charged with or convicted of a sexual offense.

Filed from the courthouse when criminal charges are made.

Domestic Violence Restraining Order– An order issued by a judge to protect the victim from the perpetrator.

Filed at the county superior courthouse Monday through Friday during business hours or at the police department when the courthouse is closed.
